Description
The California Department of Transportation (Caltrans) District 4 intends to purchase Pre-Transfer Mitigation Credits for Wetlands, Other Waters of the U.S. and State, California red-legged frog (CRLF), and Myrtle silverspot butterfly (MSB) within the Gualala Salmon HUC-8 Sub- Basin. This sub-basin represents the minimum service area required to address the anticipated mitigation needs. By November 1st, 2029, the Pre-Transfer Mitigation Credits must be available and secured to offset Caltrans expected unavoidable impacts on Wetlands, Other Waters of the U.S. and State, CRLF, and MSB. These impacts are regulated under the California Coastal Act (Public Resources Code § 30000 et seq.); Clean Water Act (CWA) Sections 401 and 404 (33 USC § 12511376); federal Endangered Species Act (FESA) Section 7; California Endangered Species Act (CESA) (FGC § 2080.1); Lake and Streambed Alteration Program (FGC § 1600 et seq.); and Porter-Cologne Water Quality Control Act (Water Code § 13000 et seq.).
