Fence & Defensive Barrier Installation for TSA at Milwaukee Mitchell International Airport (MKE)

Amendment A00004 (9/2/2026): The purpose of this amendment is to provide responses to industry questions, incorporate additional terms and conditions, and extend the due date and time for submission of quotes. Industry Questions and Government Responses: Question #1: On-Site Presence for Administrative Meetings: The SOW designates the "Contractor" as the lead for Phase I Site Surveys and the Phase III Final Site Inspection (Deliverable 6). If our firm utilizes a highly qualified local subcontractor for physical installation, will the TSA permit our designated Prime Contract Project Manager to attend these meetings virtually, or is the physical, on-site presence of the Prime Contractor's administrative representative required? Government Response: The Prime Contractor remains responsible for all contract performance. Virtual attendance by the Prime’s Project Manager is permitted provide a qualified on-site representative is physically present for the site survey, installation coordination, and final inspection. The Government reserves the right to require in-person attendance if needed at a date and time that is mutually agreeable to the parties. Question #2: County Insurance Filing: SOW Section VIII states that the Contractor must have approved insurance on file with Milwaukee County. Will the airport authority accept the Prime's insurance file if it is supported by our local subcontractor’s active municipal policies naming Peractos LLC and Milwaukee County as additional insureds? Government Response: The Contractor must meet all insurance requirements in the SOW and any Milwaukee County or airport authority requirements. Subcontractor insurance may support the filing if it meets the required coverage and additional insured requirements, but it does not relieve the Prime Contractor of responsibility. Final acceptance of insurance documentation is subject to Milwaukee County/airport authority approval. Question #3: Defensive Berm & HESCO Technical Specifications: SOW Section III requires a 10-foot-high (13-foot on one side), 3-foot-thick horseshoe-shaped dirt berm utilizing "HESCO style or similar defensive barriers" filled with compacted imported dirt. To support accurate material takeoff and shipping pricing, could the Government provide the total linear footage or perimeter footprint dimensions of the required horseshoe configuration? Additionally, are there specific technical model numbers required for the HESCO barriers, or any structural compaction density tests required for the fill dirt? Government Response: Quoters should base their quote on the SOW requirements and any observations and/or measurements taken during the optional site visit. The Government cannot provide the total linear footage or perimeter dimensions for the horseshoe configuration. Please include the total linear footage and perimeter dimensions as part of the high-level design plan in your Factor 1 - Draft Project Plan response. No specific HESCO model number is required. Any ‘HESCO style or similar’ product must meet the required height, thickness, configuration, and stability requirements. Compaction testing is not required. Question #4: Electrical Infrastructure Specifications: SOW Section III (Phase II - Electrical Requirements) specifies running electrical lines approximately 180 feet from the canine kennel to a new utility pole, and subsequently to the magazine. Could the Government provide the electrical parameters (voltage, phase, and amperage) of the power source at the canine kennel? Additionally, are the utility pole, exterior lighting fixture, and conduit to be entirely contractor-procured, or is any of this equipment being provided as Government-Furnished Property (GFP)? Government Response: The Government will not provide Government Furnished Equipment (GFE) / Government Furnished Property (GFP). Quotes must include all materials, equipment, labor, and installation necessary to complete the electrical work in accordance with the SOW. The Contractor must verify existing electrical conditions during the comprehensive site survey in Phase 1 - Design. Question #5: Limitations on Subcontracting (FAR 52.219-14): We note that the solicitation is a Total Small Business Set-Aside under NAICS 238990. However, FAR Clause 52.219-14 is not listed among the filled-in clauses under FAR 52.212-5. Could you please confirm if the Limitations on Subcontracting clause is applicable to this requirement? If so, does the standard 25% self-performance requirement for specialty trade contractors apply, or is subcontracting up to 100% of the on-site installation labor permissible? Government Response: FAR Clause 52.219-14 “Limitations on Subcontracting” (Oct 2022) does not apply as this requirement is being set aside for Total Small Business and the contract amount is not expected to exceed the simplified acquisition threshold. Question #6: Wage Determination Standards (SCA vs. DBA Construction Rates): SOW Section III details on-site civil works, concrete post embedment, and structural barrier installation. However, Attachment 2 incorporates a Service Contract Act (SCA) Wage Determination (No. 2015-4899) rather than a Davis-Bacon Act (DBA) construction wage determination. Could the Government please confirm if all on-site physical construction labor is to be mapped strictly to the provided SCA classifications, or if a DBA Wage Determination will be issued for the construction/installation portion of the work? Government Response: The Government has reviewed the applicable labor standards requirements and will amend the solicitation to incorporate Attachment 5 - Davis-Bacon Act WD # WI20260001 for the installation portion of the requirement. The Davis-Bacon Act wage determination applies to laborers and mechanics performing physical installation work at the site, including fence installation, post embedment, gate and barbed wire installation, defensive barrier/berm installation, fill placement and compaction, electrical installation, site restoration, and related punch list work. Attachment 2 - Wage Determination No. 2015-4899 applies to covered service employees performing separable non-construction support services, including administrative coordination, project documentation, permit support, meeting minutes, and closeout documentation. Quoters are responsible for properly classifying employees and complying with all applicable wage determinations incorporated into the solicitation. Question #7: Contract Documents, Statement of Work, Section III, Phase II – Electrical Requirements. Please advise if electrical feed of +- 180’-0 can be run overhead? Government Response: Quoters may include an overhead electrical run as part of their high-level design plan. Any overhead electrical work is subject to Government review and approval, airport authority requirements, applicable electrical codes, and Federal Aviation Administration (FAA) notification/determination requirements under 14 CFR Part 77, including submission of FAA Form 7460-1 if required. Question #8: Contract Documents, Statement of Work, Part B. Technical Requirements, Phase I Design. Please advise if required comprehensive site survey and preliminary design drawings need to be prepared by a registered Wisconsin engineer? Government Response: Not required. Question #9: Contract Documents, Statement of Work, Part B. Technical Requirements, Phase I Design. Please advise if required comprehensive Site Survey, Site Layout Drawings need to be prepared by a registered (stamped) Wisconsin engineer? Government Response: Not required. Question #10: Contract Documents, Statement of Work, Part B. Technical Requirements, Phase I Design. Please advise of any Tenant Construction Permit Application costs? Government Response: There are no fees associated with Tenant Improvement Plan (TIP) application submissions. Question #11: Part C states "The Contractor must confirm with the Milwaukee Mitchell International Airport (MKE) airport authority to determine the specific required insurance limits." What are the required limits? Those noted in the paragraph are quite excessive for our type of work. Government Response: Milwaukee County/airport authority will determine the applicable insurance requirements upon review of the Tenant Improvement Permit (TIP) application. For quote preparation purposes, Quoters may assume commercially standard insurance coverage for this type of fence, barrier, and electrical installation work at an airport site. If Milwaukee County/airport authority imposes insurance requirements that materially differ from those identified in the solicitation or reasonably anticipated for this type of work, the Contractor shall promptly notify the Contracting Officer. Section III, Paragraph B in the Statement of Work (SOW) states as follows: “The Contractor shall not acquire any materials or schedule any work for Phase II until a notice-to-proceed is obtained in writing from the Contracting Officer. A construction permit must be obtained from Milwaukee County before the project can continue”. Any resulting cost or schedule impact will be reviewed by the Government in accordance with the terms and conditions of the contract before a notice-to-proceed (NTP) is issued for Phase II. Question #12: Please confirm source of fill dirt materials for the HESCO barriers. (Previously specified as supplied by owner) Please advise. Government Response: Soils/sand for the HESCO barriers must be provided by the Contractor. Question #13: Contract Documents, Statement of Work, Part A. General Requirements, indicates to: submit a draft project plan concurrently with their quote detailing and including “high level design drawings”. Please advise if a Wisconsin licensed engineer should be hired by this contractor to prepare “high level design drawings” to submit with the bid? Government Response: Please see the responses to Questions #8 and #9. A Wisconsin licensed engineer is not required to prepare the high-level design drawings to submit with the quote package. No more than two (2) participants from each Quoter will be permitted to attend. The Government will confirm your registration and provide site access instructions. This site visit is not mandatory to submit a quote but encouraged. The due date and time for the submission of quotes is hereby extended to 12:00 PM local Washington D.C. time on 9/8/2026. TSA intends to provide another optional site visit, but requests that interested Industry Partners confirm their intent to bid on this procurement. Should TSA receive sufficient interest, then additional details will be provide regarding another optional site visit. If TSA does not receive sufficient interest, then TSA may cancel this reprocurement and repost on the Unison Marketplace. The Draft Project Plan shall demonstrate the Quoter’s ability to meet the objectives and requirements outlined in the SOW. Acknowledgement Quoter agrees to all clauses, terms, and conditions as shown in the RFQ. Section 2: Price Quote Quoters shall submit a Price Quote in a Microsoft Excel 2016 compatible document that includes unit and total pricing for all CLINs. The Quoter shall also provide a breakdown of proposed prices in the Microsoft Excel workbook showing, at a minimum, the labor rates, labor hours, materials, and any other direct costs to demonstrate how these costs build up to the proposed price for each CLIN. Pricing assumptions and exceptions shall be included in this worksheet. No fractional pricing should be included (i.e. round all pricing to the nearest cent $X.XX). Section 3: The Quoter shall complete and submit RFQ Attachment 3 – Quoter Representations. (ix) Evaluation Criteria: FAR Provision 52.212-2 “Evaluation-Commercial Products and Commercial Services” (Nov 2021) does not apply to this solicitation. The Government intends to evaluate submittals and award a purchase order on initial submittals without exchanges but reserves the right to enter exchanges. A submittal in response to the RFQ must contain the Quoter’s best terms from price standpoint. The Government reserves the right to award one or no purchase order at all. Quoters are encouraged to submit their best and final quote. The Government will make an award for this solicitation based on lowest price technically acceptable (LPTA). Technical tradeoffs will not be made, and no additional credit will be given for exceeding acceptability. The Government will review the two lowest priced quotes to determine whether the technical submissions meet the Government’s requirements set forth in the SOW. If one of the lowest priced Quoters is not found technically acceptable, the Government will review the next lowest priced Quoter until there are two Quoters that are determined to be technically acceptable. Award will be made to the Quoter with the lowest evaluated price, evaluated as technically acceptable, and deemed responsive to the solicitation requirements. Once the Government determines the Quoter that is the lowest-priced technically acceptable (i.e., the apparent successful Quoter), the Government reserves the right to communicate with only that Quoter to address any remaining issues, if necessary, and finalize a Purchase Order with that Quoter. These issues may include technical and price. If the parties cannot successfully address any remaining issues, as determined pertinent at the sole discretion of the Government, the Government reserves the right to communicate with the next lowest-priced Quoter based on the original analysis and address any remaining issues. Once the Government has begun communications with the next Quoter, no further communications with the previous Quoter will be entertained until after the Purchase order has been awarded. The Government will evaluate quotes using the evaluation factors set forth below: Factor 1 – Draft Project Plan The Draft Project Plan will be evaluated on an “Acceptable” or “Unacceptable” basis. To be rated “Acceptable,” the Draft Project Plan must clearly demonstrate a clear and feasible approach to completing the work described in Attachment 1 – Statement of Work (SOW). This includes: A preliminary schedule, high-level design drawings, and identification of proposed staffing, materials, and equipment resources. Quality control measures and risk mitigation strategies to ensure compliance with purchase order requirements. Site access, safety protocols, coordination with the Government, and any anticipated impacts to ongoing site operations. A quote will be rated “Acceptable” if it addresses all the above elements and demonstrates a clear and feasible approach to meeting the SOW requirements with no deficiencies. A quote that fails to address any of the above elements or does not demonstrate an ability to meet the requirements, will be rated “Unacceptable.” Only quotes rated “Acceptable” will be eligible for award. Factor 2 – Price The Government will evaluate Factor 2 as follows: The proposed prices will be evaluated based on the total evaluated price of the quote, calculated by adding together the proposed prices for each line item identified in solicitation price schedule. The Government will evaluate the fair and reasonableness of the total evaluated price based on competition. However, the Government reserves the right to utilize any of the price analysis techniques prescribed below to determine fair and reasonable pricing: Comparison of proposed prices received in response to the solicitation. Comparison of the proposed prices to historical prices paid, whether by the Government or other than the Government, for the same or similar items. Comparison with competitive published price lists. Comparison of proposed prices with independent Government cost estimates. The total evaluated price for each quote will be compared to all other quotes to determine the apparent lowest-priced quote and as noted, will be evaluated for fairness and reasonableness, but will not receive an adjectival rating. (x) Quoter Representations: Quoters shall complete RFQ Attachment 3 – Quoter Representations and submit with their offer.
