Disclaimer & General Information This is a Notice of Intent to Sole Source only. This notice does not constitute a Request for Quote (RFQ), Invitation for Bid (IFB), or Request for Proposal (RFP), nor does it commit the U.S. Government to contract for any supply or service. The Government will not pay for any information or administrative costs incurred in response to this notice. A determination by the Government not to compete this proposed action based upon responses to this notice other information available to the Government, is solely within the discretion of the Contracting Officer. However, if a competitive solicitation is subsequently released, it will be synopsized on the Governmentwide Point of Entry (GPE) at www.sam.gov. 2. Proposed Sole Source Contractor The U.S. Government intends to award a Firm-Fixed-Price contract on a sole-source basis to: Contractor Name: Bruker Scientific, LLC Contractor Address: 40 Manning Road, Billerica, MA 01821-3915 CAGE Code / UEI: 03JW7 / MG2JF771VWU5 3. Statutory & Regulatory Authority This sole-source commercial acquisition valued at or below the simplified acquisition threshold is conducted under the authority of the Revolutionary FAR Overhaul (RFO): FAR 12.201-1 and supported by RFO FAR 6.103-1 ("Only one responsible source and no other supplies or services will satisfy agency requirements"). 4. Requirement Description & Scope Summary of Requirement: This requirement is for a one-time, firm-fixed-price purchase of proprietary MALDI Biotyper (MBT) software modules. These commercial software licenses are required to upgrade an existing Government-owned Bruker Biotyper instrument (ECN 223513). The legacy software currently installed lacks the mission-essential capability to perform sub-species microbial speciation of foodborne pathogens. Bruker Scientific, LLC is the sole developer and provider of software modules compatible with the existing Bruker Biotyper platform, and no other source can provide legally and technically compatible software for this system. Location/Place of Performance: Food Analysis and Diagnostic Laboratory (FADL), JBSA Fort Sam Houston, Texas 78234. Period of Performance (PoP): This is a one-time supply action with a required delivery of approximately 8 weeks after receipt of order (ARO). There are no option years. Anticipated NAICS Code: 513210 Software Publishers SBA Size Standard: $47M Product Service Code (PSC): 7A21 IT and Telecom – Business Application Software (Perpetual License Software) 5. Mandatory Verbatim Statement (RFO FAR 5.207) All responsible sources may submit a capability statement, proposal, or quotation, which shall be considered by the agency. 6. Submission Requirements for Capability Statements If your firm believes it can fulfill this requirement, please submit a capability statement addressing the following points in sufficient detail to allow the Government to make a technical capability determination: Company Profile: Company Name, Point of Contact (Name, Title, Phone, Email), SAM Unique Entity Identifier (UEI), CAGE Code, and active business size/socioeconomic status (e.g., Small Business, SDVOSB, 8(a), WOSB, HUBZone). NAICS Feasibility: State whether your firm agrees that the contemplated NAICS code 513210 is the most appropriate. If not, suggest an alternative NAICS code with supporting rationale. Active/Direct Technical Experience: Provide detailed evidence of experience performing identical or closely related services within the last three (3) years. Specify whether experience was as a prime contractor or subcontractor. Subcontracting / Teaming Arrangements: Identify whether your firm intends to compete as a prime contractor, or if joint ventures, mentoring agreements, or teaming arrangements will be pursued. Note: Small business primes must confirm compliance with the 50% Limitation on Subcontracting rule (RFO FAR 52.219-14). 7.
