NOTE: THIS IS NOT A COMPETITIVE SOLICITATION OR REQUEST FOR BIDS. IT IS A "NOTICE OF AGENCY DECISION TO ENTER INTO NEGOTIATIONS WITH THE INTENT TO AWARD A COMPETITIVELY SOLICITED CONTRACT" WHICH IS POSTED PURSUANT TO §287.057(3), F.S. §120.57(3), F.S., AND RULE 60A-1.045, F.A.C. BE SURE TO READ THE ENTIRE ADVERTISEMENT BEFORE CONTACTING THE AGENCY WITH BID RELATED QUESTIONS. The following vendors submitted bids that were disqualified: BAKER DESIGN BUILD – Appendix G was incorrectly completed and verification was not obtained by deadline. J.D. HINSON – Appendix A was missing the notation of Addendum #3. TETHER, INC – Wrong Appendix I – Vendor Proposal Form submitted; did not use updated form. Florida School for the Deaf and the Blind (FSDB) and the Selection Committee sincerely appreciates the time, care, and effort employed by all respondents to the subject solicitation in the production of their proposals. FSDB intends to pursue §287.057(6), F.S. that provides that if less than two responsive bids or proposals are received in response to a solicitation, the Agency may negotiate the best terms and conditions. FSDB will be negotiating with CGC, Inc. Protests and Disputes: Questions submitted to FSDB shall not constitute formal protest. A notice of protest must be submitted to the Florida School for the Deaf and the Blind in writing within 72 hours of the Notification of Intent to Award. A formal written protest must be submitted within ten (10) days after the date the notice of protest is filed. The formal written protest must fully identify facts resulting in the contested issues. The protest procedure shall be governed by Florida Statutes §120.57(3) and may require the payment of a Protest Bond IAW §28-110-005, F.S. Any person who is adversely affected by the Florida School for the Deaf and the Blind’s decision concerning a procurement solicitation or contract award and who wants to protest such decision shall file a protest in compliance with §120.57(3), FS. Failure to file a protest within the time prescribed in Section 120.57(3), F.S., or failure to post the bond or other security required by law within the time allowed for filing a bond shall constitute a waiver of proceedings under Chapter 120, F.S.
