Description
NOTICE OF RIGHT-OF-WAY AMENDMENT APPLICATION Trans-Alaska Pipeline System, ADL 63574 Middle Fork Koyukuk River Grade Control Sill At Pipeline Milepost 208 The Alaska Department of Natural Resources (DNR), pursuant to Alaska Statute (AS) 38.35.070, gives notice that Alyeska Pipeline Service Company (APSC) submitted a request to amend the Trans-Alaska Pipeline System (TAPS) Right-of-Way (ROW) Lease, ADL 63574, to add State land to the ROW at a TAPS crossing of the Middle Fork Koyukuk River. In the past decade there has been continuing bank erosion upstream of the pipe crossing at Pipeline Milepost (PLMP) 208 due to channel changes. The changes in flow pattern resulted in flow concentration on the north bank and local stream degradation in the vicinity of the Pipeline within the active floodplain. APSC proposes to install an initial grade control rock structure downstream of the pipe and fill in a depression in the pipe vicinity. In order for equipment to reach and place rock in the area of interest, the grade control structure near the north bank will be temporarily raised above water level by placing additional rock. Once completed the additional fill material used to build the platform will be removed. Equipment used would include front-end loaders, backhoe, and trucks. The requested amendment area is located on lands adjacent to the westerly and easterly TAPS ROW boundary within: the SE1/4 of the NW1/4 of Section 9, Township 32 North, Range 10 West, Fairbanks Meridian, containing a total of approximately 2.63 acres. The requested lands would be surveyed and may include less acreage than approved for construction. The application is available online at: http://dog.dnr.alaska.gov/home/newsroom. The public may obtain hard copies of the application, at cost, from the DNR at the address below. AS 38.35.200 governs judicial review of decisions of the commissioner: Sec. 38.35.200: Judicial review. (a) An applicant or competing applicant or a person who has direct financial interest affected by the lease who raises objections within 60 days of the publication of notice under AS 38.35.070 are the only persons with standing to seek judicial review of a decision of the commissioner under AS 38.35.100. (b) The only grounds for judicial review of a decision of the commissioner are (1) failure to follow the procedures set out in this chapter; or (2) abuse of discretion so capricious, arbitrary, or confiscatory as to constitute a denial of due process.
