Description
NOTICE OF RIGHT-OF-WAY LEASE AMENDMENT APPLICATION Trans-Alaska Pipeline System, ADL 63574 Failsafe Structures and Permanent Riprap Stockpile Locations at Pipeline Mileposts 77.5, 78.25, 81, and 82.4 The Alaska Department of Natural Resources (DNR), pursuant to Alaska Statute (AS) 38.35.070, hereby gives notice that Alyeska Pipeline Service Company (APSC) submitted a request to amend the Trans-Alaska Pipeline System (TAPS) Right-of-Way (ROW) Lease, ADL 63574, to add State land to the ROW along TAPS, about 77 to 82 miles south of Deadhorse, Alaska, along the east bank of the Sagavanirktok River. Strategic riprap stockpiles will be placed west of the buried pipeline, between TAPS and the Sagavanirktok River. The stored riprap will serve a dual purpose: a) to intercept an unforeseen rapidly eroding bank towards the pipeline, b) to be used as needed in case of emergency of future planned work (e.g. buried sill) along this reach of the river where the pipeline and its workpad are not connected by access road to the Dalton Highway. The TAPS right-of-way width west of the pipeline is 23-feet wide, and additional width is needed to store the riprap offset from the pipeline ditch including a sufficient buffer between the stored rock and the pipeline. This configuration will prevent the riprap from contacting the pipeline in the event of severe bank erosion. If the erosion reaches the stored stockpiled rock, the riprap will drop to arrest further erosion toward the pipe. The dropping riprap will fall towards the erosion and away from the pipeline, avoiding damage to the pipeline coating and/or steel. The requested amendment areas are located on lands adjacent to the westerly boundary of the TAPS ROW Lease (ADL 63574) in the following areas within the Umiat Meridian: Stockpile Area 1 at Pipeline Milepost (PLMP) 82.5, within the SW1/4 of Section 32, Township (T) 3 South (S), Range (R) 14 East (E), and the NW1/4 of Section 5, T4S, R14E, containing approximately 6.1 acres; Stockpile Area 2 at PLMP 81, within the NE1/4 of Section 29, T3S, R14E, containing approximately 10.9 acres; Stockpile Area 3 at PLMP 78.25, within the SW1/4 of Section 9, T3S, R14E, containing approximately 4.7 acres; and Stockpile Area 4 at PLMP 77.5, within the NW1/4 of Section 9, T3S, R14E, containing approximately 4.4 acres. There is a total of about 26.1 acres for the four Stockpile Areas. The application is available online at: http://dog.dnr.alaska.gov/home/newsroom . AS 38.35.200 governs judicial review of decisions of the commissioner: Sec. 38.35.200: Judicial review. (a) An applicant or competing applicant or a person who has direct financial interest affected by the lease who raises objections within 60 days of the publication of notice under AS 38.35.070 are the only persons with standing to seek judicial review of a decision of the commissioner under AS 38.35.100. (b) The only grounds for judicial review of a decision of the commissioner are (1) failure to follow the procedures set out in this chapter; or (2) abuse of discretion so capricious, arbitrary, or confiscatory as to constitute a denial of due process.
