Notice of Application for State Water Quality Certification Public Notice (PN) Date : August 19, 2026 PN Reference Number : POA-2026-00541 v1.0 PN Expiration Date : September 18, 2026 Waterway : Knik Arm Any applicant for a federal license or permit to conduct an activity that might result in a discharge into waters of the United States, in accordance with Section 401 of the Clean Water Act (CWA), must also apply for and obtain certification from the Alaska Department of Environmental Conservation that the discharge will comply with the CWA and the Alaska Water Quality Standards (18 AAC 70). The scope of certification is limited to the water quality-related impacts of the activity subject to the Federal license or permit (40 CFR 121.3, 18 AAC 15.180). Notice is hereby given that a request for a CWA §401 Water Quality Certification of a Department of the Army Permit application, Corps of Engineers’ PN Reference Number indicated above, has been received [1] for the discharge of dredged and/or fill materials into waters of the United States (WOTUS), including wetlands, as described below, and shown on the project figures/drawings. The public notice and related project figures/drawings are accessible from the DEC website at https://dec.alaska.gov/water/wastewater/ . Project Name : NC Machinery Commercial Development – Anchorage Facility Dates of the proposed activity are planned to begin and end : 08/15/2026 to 08/15/2028 Location : The proposed activity is located within Section 18, T. 12 North, R. 3 West, Seward Meridian, in the Municipality of Anchorage, Alaska. Project Site (Latitude, Longitude): 61.12948, -149.8890. Purpose : The applicant’s stated purpose is to establish a new N C Machinery commercial facility operation, dealership, and service center for Caterpillar Brand heavy equipment in Anchorage, Alaska. Description of Proposed Work : The applicant proposes placing 214,000 cubic yards of sand-and-gravel mix into 19.94 acres of palustrine wetlands to develop a 24.82-acre lot for commercial use. Earthwork activities would consist of excavation and import of soil to prepare the site, including excavation of 8 feet of organic (peat) material down to mineral soil directly below the proposed main building footprint, and filling with imported classified sand and gravel to achieve finished grade. The project would include the construction of the main and support buildings, loading docks, parking lots, laydown and equipment yard, driveway, four (4) 36 feet long by 24-inch diameter culverts, plain cement concrete sidewalks, chain-link fence, three (3) swing gates, landscape areas, snow storage area, storm water retention basins, and drainage swales. Additional Information: On April 28, 2014, an Individual Permit was issued to Mr. Leonard Hyde to fill 19.94 acres of palustrine wetlands with 480,000 cubic yards for the purpose of constructing an outlet mall and attendant features. The authorized outlet mall was not constructed. Applicant Proposed Mitigation : The applicant proposes the following mitigation measures to avoid, minimize, and compensate for impacts to waters of the United States from activities involving discharges of dredged or fill material. Avoidance : The project is unable to avoid impacts to wetland areas as the proposed project needs 24.82 acres to develop an approximately 129,774 square-foot building, an approximately 19,495 square-foot support building, with associated parking and laydown/equipment yard. Minimization : The project would minimize impacts to wetlands by creating retention basins on the west side of the property. These basins would have a similar elevation to the pre-project wetland elevation of 84 feet. The retention basins would total 0.55 acres, which would be graded to similar elevations as the pre-existing wetlands. Stormwater would be conveyed through drainage swales placed on the north, east, and south of the development, discharging into retention basins located on the west of the development. Overflow from retention basins would be discharged into the Municipality of Anchorage right-of-way section line easement on the west side of the project. Stormwater management would utilize 0.55 acres of wetlands; therefore, the project would fill 19.39 acres of wetlands (temporary fill/impacts to 0.55 acres of wetlands). Peat excavated under the main building footprint would be disposed of at the permitted Anchorage Sand and Gravel Sand Lake facility. Mitigation : The Harnish Group Inc. proposes no mitigation as compensatory mitigation has been completed for the fill of 19.94 acres of wetlands through POA-2013-00541 acquisition of 15.149 credits. Acquisition of credits was completed in 2022, as documented below Purchase of 4.13 credits on May 1, 2014 from the Harmany Ranch Wetland Mitigation Bank Purchase of 7.88 credits on July 15, 2014 from Great Land Trust Purchase of 0.336 credits on January 21, 2022 from Great Land Trust Preservation of 6.963 acres to generate 2.803 credits through permittee-responsible mitigation by placing a conservation easement (December 21, 2021) and long-term management plan (November 2021) After reviewing the application, the Department will evaluate whether the activity will comply with applicable water quality requirements (any limitation, standard, or other requirement under sections 301, 302, 306, and 307 of the CWA, any Federal and state laws or regulations implementing those sections, and any other water quality-related requirement of state law). The Department may certify (or certify with conditions) with reasonable assurance the activity and any discharge that might result will comply with water quality requirements. The Department also may deny or waive certification. The permit application and associated documents are available for review.
