NOTICE OF WATER RIGHT APPLICATION LAS 36123 Pursuant to AS 46.15.133 and 11 AAC 93.080, notice is hereby given that Alaska Railroad Corporation, 327 W Ship Creek Ave, Anchorage Alaska 99501, applied for a permit to appropriate water on July 2, 2026. The application is for an existing closed non-contact cooling system for the historic Anchorage Railroad Depot building. The water right application requests: Source of Water: Existing 365’ deep well Amount of Water: 115,200 gallons per day Season of Use: May 1 through October 1 Type of Use: Industrial Cooling This use is currently authorized under a Temporary Water Use Authorization (TWUA) A2021-110, which expires on August 22, 2026. Per 11 AAC 93.130(a), only the amount of water beneficially used and documented by water use records can be certified in a water right. Current water use records (2016-2025) indicate a maximum monthly withdrawal not to exceed 1,852,000 gallons and a combined seasonal withdrawal limit not to exceed 5,000,000 gallons total. Legal Description of the Water Source and Area of Appurtenance: Tract G, Alaska Railroad Anchorage Terminal Reserve Subdivision, USS 1170, according to Plat 2021-30, records of the Anchorage Recording District, Third Judicial District, State of Alaska. Legal Description of the Water Discharge Route: Water is discharged into an existing 800’ long on-site storm drain system starting in Tract G, Alaska Railroad Anchorage Terminal Reserve Subdivision, Plat 2021-30; traveling north through the Storm Drain Easement, Tract B, Ship Creek Crossing Subdivision, Plat 96-80; continuing north back into Tract G, Alaska Railroad Anchorage Terminal Reserve Subdivision, Plat 2021-30, before outfalling into Ship Creek. Said plats are recorded in the Anchorage Recording District, Third Judicial District, State of Alaska. Per AS 46.15.133(a), within 15 days of publication or service of notice, persons may file with the director written objections. Comments or objections must be made in writing by email to lesli.schick@alaska.gov or by mail to Alaska Department of Natural Resources, Water Resources Section, 550 W 7 th Ave, Suite 1020, Anchorage, Alaska 99501-3562 by August 3, 2026 . Pursuant to 11 AAC 93.080(6), “The public comment period set by AS 46.15.133 (c) begins the first day the newspaper publication appears, or the first day of posting, or upon receipt of the notice as evidenced by the certified mail receipt, date stamp, or other evidence of actual service.” Objection must include the objector’s name and address, and any facts tending to show that the rights of the objector or the public interest would be adversely affected by the proposed appropriation.
